Can I stop my divorce?

There are certain situations where you can stop your divorce proceedings:

1. You are the Petitioner- If you filed the Petition for Divorce and your spouse did not file a Counterpetition, you can file a Motion to Nonsuit your divorce and dismiss the suit; or

2. Both Spouses Agree – If you are not the Petitioner or if your spouse filed a Counterpetition in response to your divorce action, but you both agree to stop the divorce proceedings, you may file a Motion to Nonsuit and ask that the court dismiss the divorce suit.

Please note that Texas is a no-fault divorce state, so the divorce can be finalized even if only one spouse wants to proceed with the divorce.
