After filing, there's a 60-day waiting period. There are two ways to end a marriage: no-fault divorce and fault-based divorce. Cases of no-fault imply there has been conflict or that you and your partner haven't been living together for at least 3 years. Fault-based cases are, however, different.

To qualify, one of the following factors must be present:

  • Adultery
  • Abandonment
  • Cruel and inhumane treatment
  • Confinement for incurable insanity for 3 years
  • Conviction of a felony resulting in imprisonment for more than a year

Some cases can be executed through mutually agreed-upon terms. When issues such as custody, which are typical concerns of divorcing couples, can be resolved amicably, the process can be exceuted more easily. On the other hand, divorces of default must be executed when one partner doesn't sign the required papers; therefore, the partner who filed is permitted all requests.
